Enforcement activity
On July 28, 1997, a Temporary Restraining Order was sought by the Division in Lake County, Ohio, against The Infinity Group Company. The TRO was granted by Lake County Common Pleas Judge Martin O. Parks on July 28, 1997, which prohibited the company from selling securities until it complied with a subpoena and examination request of the Division and made records available to the Division.
A Preliminary Injunction was issued by Lake County Common Pleas Judge Martin O. Parks on August 7, 1997, against The Infinity Group Company. The company was ordered to turn over records to the Division that they still had not provided.
On August 9, 1997, Robert DeLuna was arrested in Lakewood, Colorado. Deluna was indicted by a Franklin County Grand Jury on November 3, 1994, on 21 counts, including 5 counts of theft and 4 counts each of the sale of unregistered securities, false representations in the sale of securities, securities fraud and the unlicensed sale of securities.
