BY THE OHIO DEPARTMENT OF COMMERCE’S DIVISION OF SECURITIES

 

 

At the request of media representatives, the Ohio Department of Commerce’s Division of Securities releases a summary list of Division Orders and enforcement actions recently brought by the Division’s Enforcement Section.

 

Before reporting information based on this INFORMATION RELEASE, the Department suggests that reporters request additional detail as to the nature of the Division Order or enforcement action.

Criminal Activity

 

The 6th Circuit Court of Appeals denied Albert J. DeSantis' petition for rehearing en banc in an Order issued by the Court on February 7, 2001.  On December 13, 2000, the Sixth Circuit U.S. Court of Appeals had affirmed Albert J. DeSantis' September 17, 1998 federal conviction and sentence.  On September 17, 1998, DeSantis was convicted on one count of securities fraud and five counts of mail fraud following a jury trial in U.S. District Court in Columbus.  He was sentenced on March 12, 1999 to 51 months imprisonment, 3 years probation, and ordered to pay restitution to investors of over $1.6 million.  This was a retrial of his earlier conviction on the same case, after the Sixth Circuit Court of Appeals overturned his first conviction on judicial error.  DeSantis' conviction stemmed from the marketing and sales of limited partnership interests to investors in Campus Businesses Limited Partnership, which included a number of the campus bar businesses in the Ohio State University area.

 

On February 9, 2001, U.S. District Court Judge James Graham accepted Joseph Erwin’s guilty plea to mail and wire fraud counts associated with his activities at Eisner Securities.  Erwin embezzled $2.6 million from customer accounts during a 3.5 year period.  A sentencing date has not been set.  The Ohio Division of Securities suspended Erwin’s securities salesman license in September 2000, and thereafter, revoked his license on February 5, 2001.
